Short version: everything we publish is original and ours. Your files and logos stay on your computer, so we never host them. If you think something of yours is being misused, tell us and we act fast.
What's ours
The ChartBackgrounds skins, animations, extension code, website, name and logo are original works owned by ChartBackgrounds. Your plan gives you a personal license to use them inside the extension. You may not copy, extract, resell, redistribute or repackage them, or use them to build a competing product. Screenshots and clips of your own chart with a skin on it are always fine to post.
What's yours
- My media and Brand: videos, images and logos you add are stored only on your computer, inside the extension. We never upload, host or see them. You're responsible for having the right to use them.
- Server Kits: when a community sends us a logo or artwork for a kit, they confirm they own it or have permission, and give us a license to use it only to build and deliver that kit. They can ask us to remove it at any time.
- Setup of the Week posts: when you send us a post, you give us permission to share it with credit to you. Ask and we take it down.
Reporting a copyright problem
We respond to notices under the U.S. Digital Millennium Copyright Act (DMCA) and similar laws. Send a notice with:
- Your physical or electronic signature.
- The copyrighted work you believe is being infringed.
- Where the material appears (a link, or the skin or kit name).
- Your name, mailing address, phone number and email.
- A statement that you believe in good faith the use isn't authorized by the owner, its agent, or the law.
- A statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
Where to send it: email [email protected] with the subject "Copyright notice", or use the contact form and pick "Copyright or trademark". We remove or disable access to material while we review a valid notice.
Counter-notice
If something of yours was removed and you believe that was a mistake, send a counter-notice with your signature, what was removed and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, and your name, address, phone number and consent to the jurisdiction of the federal district court for your address (or, outside the U.S., any judicial district where ChartBackgrounds may be found). Unless the original sender tells us they've filed a court action, we may restore the material in 10 to 14 business days.
Repeat infringers
We end the Server Kit, Creator Code or rewards access of anyone who repeatedly infringes, and may end their license to use ChartBackgrounds.
False claims
Knowingly misrepresenting that material is infringing, or that it was removed by mistake, can make you liable for damages under 17 U.S.C. § 512(f).
Trademarks
ChartBackgrounds and the ChartBackgrounds logo are our trademarks. Don't use them in a way that suggests we endorse or made something we didn't. Creators with a Creator Code may use our name to describe the product. TradingView is a trademark of TradingView, Inc. ChartBackgrounds is independent and is not affiliated with, endorsed by, or sponsored by TradingView, Inc.
Our own work
If you see our skins, code or brand copied somewhere else, we'd be grateful if you told us through the contact form.
